Terms And Conditions

Applicability. These terms and conditions apply between you and It'sBeanCalledJava with respect to your purchases of products ("Products") from It'sBeanCalledJava (the "Internet Purchase Page"). These terms and conditions shall apply and not be altered without the express written permission from It'sBeanCalledJava.

Sales from the Internet Purchase Page are limited to Customers who are at least 18 years of age.

Shipping. Company reserves the right to select alternative carriers for shipments. Shipping charges are invoiced according to costs related to UPS, FedEx or USPS. All liability for loss passes to the customer once it leaves our warehouse, however we will honor replacement merchandise for damaged shipments after the damaged item(s) have been returned to us. Claims of non-delivery will be honored if no proof of delivery is offered by UPS or USPS, otherwise merchandise shall be deemed delivered.

Payment terms 

Credit card is the default form of payment that will be accepted for Product orders on the Internet Purchase Page. We accept the following methods of payment: VISA, MasterCard, or Discover. All orders received are subject to acceptance by It'sBeanCalledJava in our sole discretion. All processed orders are subject to availability. It'sBeanCalledJava is not liable for delay in product shipment.

Time In Transit Damage Claims. Ownership of each product belongs to you, the Customer, once package is picked-up from our distribution facility by any shipping company. Any damage or loss which occurs during transit will be covered by us unless damage or loss occurs when the package is shipped by special carrier selected by the Customer. Our standard shipping company is United States Postal Service with optional UPS which can be selected at checkout where available.

We do not accept returns for perishable items, all sales are final.

Limitation of Damages & Liability. It'sBeanCalledJava is in no way liable to any Customer for any special, incidental, consequential or punitive damages, or for any claim by any third party. Customer agrees that for any liability related to the purchase of any Products, It'sBeanCalledJava is not liable for any amount of damages above the aggregate dollar amount paid by Customer for the purchases under this agreement.

Reservations & Exceptions. We reserve the right to adjust pricing on products without notice. In addition we reserve the right to modify terms, specifications and the like for Products on the Internet Purchase Page or Website at any time without notice. Any errors in Product specifications, descriptions, and pricing are subject to correction by us. We also reserve the right to reject any order that is not consistent with these terms & conditions or our sales policy guidelines.

Governing Law. Our Website, including the Internet Purchase Page, are operated and administered by offices in the State of Hawaii, U.S.A.. This agreement and any sales hereunder shall be governed by the laws of the State of Hawaii. Customer agrees to submit to the jurisdiction and venue of the federal or state courts of the State of Hawaii, County of Hawaii, for any disputes, claims or causes of action involving this Internet site, the Internet Purchase Page, or these terms & conditions. Customer and/or Website visitors agree to abide the laws of the United States and any applicable state laws. No representations are made that this Internet site, the Internet Purchase Page, or any of our Website information or materials, products or contents are appropriate or available for use outside the United States of America.
